By activating any key purchased on the Wexize platform, you agree that the digital product has been delivered and used, and that there is no right to refund after activation. Chargeback after activation is considered contractual fraud and will result in permanent ban and legal action.

1.1

Definitions

For the purposes of these Terms of Service, the following definitions apply:

Wexize — Wexize — company, platform and services operated under the Wexize brand.
Acceptance — User / Customer — any person who accesses, uses or purchases Wexize products.
Product Nature — Software / Cheat — any digital product made available by Wexize, including loaders, injectors, modules and auxiliary tools.
Key / Non-transferable Keys — Key — unique digital code that activates access to a specific product for a determined period.
8. Limitation of Liability — Platform — the website wexize.xyz, customer dashboard, API and any associated services.

1.2

Acceptance

By accessing the platform, making any purchase or activating a key, the User declares to have read, understood and fully agreed to these Terms. If you do not agree with any provision, the User must refrain from using Wexize services.

1.3

Legal Capacity

The User declares to be at least 18 years of age or the applicable legal age in their country of residence, and have full legal capacity to enter into this agreement.

1.4

Changes

Wexize reserves the right to change these Terms at any time. Significant changes will be communicated via Discord or email. Continued use of services after publication of changes implies automatic acceptance of the new provisions.

2.1

Product Nature

All products sold by Wexize are intangible digital goods delivered through a unique activation key. By making the purchase, the User acquires a non-exclusive, non-transferable license for a fixed term according to the chosen plan.

2.2

Instant Delivery

The access key is generated and delivered automatically after payment confirmation. Wexize is not responsible for delays caused by financial intermediaries, User connection failures or incorrect data provided at the time of purchase.

2.3

Activation and Term Start

The usage period starts counting from the moment of key activation, regardless of whether the User uses the software during that period. Non-use does not suspend, interrupt or extend the contracted term.

2.4

Non-transferable Keys

Activation keys are personal and non-transferable. It is expressly forbidden to sell, assign, share, publish or distribute keys to unauthorized third parties. Violations subject the offender to permanent platform ban without right to refund.

3.1

Irrevocability After Activation

There is no refund after key activation, under any circumstances. Activation represents full consumption of the contracted digital product. By activating the key, the User expressly acknowledges that the product has been delivered and that the right of withdrawal provided in the Consumer Protection Code for immediately available digital products is excluded under the terms of art. 49, §1 of Law 8.078/90, as it is digital content with supply initiated before the 7-day period upon express consumer consent.

3.2

Only Refund Hypothesis

Refunds will only be considered in the following cumulative situations:

The key was not activated by the User;
The User reported the problem within 24 hours of purchase;
The failure is demonstrably originated from a technical error on the Wexize platform, duly verified by the support team.

3.3

Chargebacks and Improper Disputes

Opening a dispute, chargeback or payment contestation for purchases of already activated keys is considered contractual fraud. Wexize reserves the right to: (i) permanently ban the User and all associated devices/accounts; (ii) report the attempted fraud to payment operators; (iii) take appropriate legal action to recover amounts and repair damages. The User agrees that the burden of proof regarding non-use of the product falls entirely on them.

3.4

Game Bans

Bans imposed by developers or anti-cheat systems of games are inherent risk assumed by the User. Wexize does not offer refund, compensation or guarantee in cases of ban, even if the software was used according to provided instructions. The User declares full awareness of this risk when making the purchase.

4.1

Absolute Prohibitions

It is strictly prohibited, under penalty of the sanctions provided in Clause 4.3:

Decompile, disassemble, deobfuscate or attempt to access the source code of any Wexize product;
Perform reverse engineering, static or dynamic analysis of the loader, injector or any module;
Intercept, monitor or manipulate network traffic between Wexize software and its servers;
Extract, copy or reproduce algorithms, bypass methods or evasion techniques present in the products;
Use debugging, hooking or instrumentation tools on Wexize processes;
Bypass, remove or modify any protection mechanism, license verification or authentication.

4.2

Intellectual Property

All code, algorithms, techniques, bypass methods, software architecture and any technical elements of Wexize products are the exclusive property of the company and protected by applicable intellectual property laws, including but not limited to Law 9.609/98 (Software), Law 9.610/98 (Copyright) and the Berne Convention.

4.3

Penalties for Violation

Violation of this section subjects the offender to: (i) immediate permanent ban from all Wexize platforms; (ii) legal action for intellectual property violation seeking compensation for material and moral damages; (iii) communication to competent authorities when the conduct constitutes a crime under Law 12.737/12 (Cybercrimes); (iv) inclusion in a permanent list of blocked users, shared with commercial partners.

4.4

Reward for Reporting

Wexize offers product rewards for users who report, with evidence, attempts of reverse engineering or code leakage by third parties. Reports should be sent via private ticket on Discord.

5.1

Prohibited Conduct

The User is prohibited, on any public or private platform:

Disseminating false, distorted or misleading information about Wexize products, services or team;
Carrying out disinformation campaigns, fraudulent reviews or coordination of reputation attacks;
Publicly claiming to have suffered damages from products without first contacting support and awaiting resolution;
Associating the Wexize brand with criminal activities, fraud or inappropriate content without proven factual basis;
Making public threats as a pressure instrument to obtain refunds or undue benefits.

5.2

Right of Reply and Legal Action

Wexize reserves the right to publicly respond to unfounded criticism and to take legal action for reputational damages based on arts. 186 and 927 of the Brazilian Civil Code and arts. 138, 139 and 140 of the Penal Code (Slander, Defamation and Injury). The User who disseminates false information will be held liable for full reparation of damages caused, including actual damages, lost profits and moral damages.

5.3

Legitimate Criticism

Nothing in this section prevents the legitimate exercise of the right to criticize and freedom of expression. Honest reports about real experiences, duly substantiated, do not constitute violation of these Terms. The distinction between legitimate criticism and defamation will be determined in each specific case.

5.4

Review Platforms

Reviews on third-party platforms should reflect real user experiences. Wexize does not interfere with genuine reviews, but reserves the right to contest and request removal of proven false reviews from the respective platforms.

The User's account will be permanently banned, without prior notice and without right to appeal, in the following cases:

6.1

Reasons for Permanent Ban

Opening chargeback or payment dispute for purchases of activated keys;
Reverse engineering, decompilation or analysis of the software (§ 4.1);
Unauthorized sharing, resale or redistribution of keys or accesses;
Use of software for purposes that compromise third-party security or cause harm to other users;
Creation of multiple accounts to circumvent previous bans (ban evasion);
Attempt to compromise Wexize infrastructure, API or servers;
Serious and proven defamation with intent to cause damage to the company's reputation;
Deliberate leakage of technical information, methods or vulnerabilities to competitors or adverse communities;
Fraud in the purchase process, such as using stolen or falsified payment methods.

6.2

Temporary Ban

Less severe conduct, such as violation of Discord rules, abusive use of support or partial non-compliance with Terms, may result in temporary suspension determined by the Wexize team, with deadline and conditions communicated to the User.

6.3

Scope of Ban

The ban may cover, cumulatively: platform account, email address, HWID (hardware identifier), IP address, Discord account and any other associated identifier. Wexize uses fingerprinting systems to detect reactivation attempts by banned users.

6.4

Third-Party Game Bans

Bans imposed by game anti-cheat (EAC, BattlEye, VAC, etc.) are the sole responsibility of the User. Wexize employs evasion techniques but does not guarantee zero detection. The User fully assumes the risk of game ban and releases Wexize from any resulting liability.

7.1

Data Collection

Wexize collects the minimum data necessary for service operation: email address, payment data (processed by certified third parties), HWID for license validation and access logs. Data is not sold to third parties.

7.2

HWID and Telemetry

The software collects the device HWID for license binding. Anonymous telemetry data may be collected for compatibility diagnosis. No identifiable personal data is transmitted without explicit consent.

7.3

Retention and Deletion

Account data is retained while the account is active and for up to 12 months after closure. Deletion requests should be sent via ticket. Transaction data may be retained due to legal obligation for up to 5 years.

8.1

General Disclaimer

The software is provided "as is". Wexize does not guarantee uninterrupted operation, absence of errors or compatibility with all hardware and software configurations. The User uses the product at their own risk.

8.2

Use at Own Risk

Use of game modification software may violate the Terms of Service of the respective games. The User declares awareness of this possibility and fully releases Wexize from responsibility for any consequences, including suspension of game accounts, loss of progress or associated damages.

8.3

Liability Cap

Under no circumstances shall Wexize's total liability to the User exceed the amount actually paid by the User in the 30 days prior to the event that caused the damage.

8.4

Exclusion of Indirect Damages

Wexize shall not be liable for indirect, incidental, special, punitive or consequential damages, including loss of data, loss of revenue, loss of game progress or business interruption, even if advised of the possibility of such damages.

9.1

Permitted Use

Wexize products are exclusively licensed for personal and non-commercial use by the license holder, on the linked device, for entertainment purposes in a gaming environment.

9.2

Prohibited Uses

Use in tournaments, championships or any organized competition;
Use to harass, harm or systematically interfere with other players' experience;
Use on servers that explicitly prohibit modifications and whose operator may be harmed;
Use to collect or exploit data from other players without consent.

9.3

Community Behavior

Users must treat other members, influencers, affiliates and employees with respect. Toxic behavior, harassment or hate speech in Wexize channels will result in Discord ban and may result in account suspension.

10.1

Applicable Law

These Terms are governed by the laws of the Federative Republic of Brazil. In case of conflict between Brazilian rules and foreign legislation, Brazilian legislation shall prevail.

10.2

Jurisdiction

The parties elect the jurisdiction of the District of São Paulo/SP as competent to settle any disputes arising from these Terms, expressly waiving any other, however privileged it may be.

10.3

Friendly Resolution

Before any legal action, the parties undertake to seek an amicable solution through official Wexize support, with a 15-day deadline for response and resolution attempt.

10.4

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
